1. Validity of the Conditions
Deliveries, services, and offers from the online shop of Cre-A-Solve AG (CHE-468.112.789 VAT), Im Ehrmerk 12, 8360 Wallenwil, are made exclusively on the basis of these general terms and conditions, even if they are not expressly agreed upon again. These terms and conditions are deemed accepted upon ordering the goods or services. Any general terms and conditions of purchase of the customer are hereby expressly rejected. Deviations from these terms and conditions are only valid if confirmed in writing by Cre-A-Solve AG.
2. Offer and Contract Conclusion
Cre-A-Solve AG's offers in price lists and advertisements do not constitute a legally binding offer, but rather an invitation to the customer to place a binding order. Offers such as verified returns or clearance items are excluded from the availability guarantee. By clicking the order button in the online shop, the customer places a binding order for the products listed on the order page. Receipt of the order is confirmed immediately. A binding acceptance by Cre-A-Solve AG only occurs with written order confirmation. If it is subsequently determined that delivery is not possible or a pricing error exists, Cre-A-Solve AG reserves the right to cancel the order or – in case of already delivered goods – to demand the price difference. In this case, the customer has the right to return the goods if they do not agree with the subsequent billing. Further claims are excluded. The information in sales documents (e.g., drawings, illustrations, dimensions, weights) is non-binding unless expressly stated in writing as binding. If a customer exceeds their credit limit through an order, Cre-A-Solve AG is released from the delivery obligation.
3. Prices
The prices stated in the order confirmation are decisive. These apply to stock items at the time of order. In case of delivery bottlenecks or procurement, the daily price on the order date applies. All prices are in Swiss Francs (CHF) including statutory VAT and – unless otherwise agreed – plus shipping costs. Price changes and errors are reserved.
4. Delivery Conditions
Orders via creaclean.ch are delivered exclusively within Switzerland and Liechtenstein. Delivery periods and dates are non-binding unless expressly agreed otherwise in writing. Compliance with delivery periods is subject to timely and complete supply by our suppliers.
5. Inspection Obligation
Customers are obliged to immediately inspect delivered or picked-up products for accuracy, completeness, and any transport damage upon receipt.
For freight deliveries, visible damage must be noted directly on the delivery note.
- Visible quantity discrepancies must be reported immediately upon receipt,
- hidden quantity discrepancies within 4 days of receipt, in writing to Cre-A-Solve AG and the carrier.
Complaints regarding damage, delay, loss, or inadequate packaging must be reported immediately after receipt of goods by email to [email protected].
Important: Products with transport damage must not be put into operation and must be stored in the original packaging.
6. Default in Acceptance
If the customer refuses to accept the delivery after expiration of a set grace period or declares that they do not wish to accept the goods, Cre-A-Solve AG is entitled to withdraw from the contract and demand damages for non-performance.
Cre-A-Solve AG may alternatively:
- claim a flat rate of 25% of the agreed purchase price or
- the actual damage incurred be claimed.
7. Risk Transfer
Risk passes to the customer as soon as the goods are handed over to the transport company. If shipping is delayed without fault of Cre-A-Solve AG or becomes impossible, risk passes to the customer upon notification of shipping readiness. An assumption of shipping costs by Cre-A-Solve AG has no influence on risk transfer.
8. Warranty / Guarantee
Cre-A-Solve AG or the manufacturer provides a 2-year guarantee from delivery date for freedom from defects and functionality, unless otherwise agreed in writing.
The guarantee expires in case of:
- Non-compliance with operating or maintenance instructions
- Modifications or interventions by third parties
- Use of non-original consumables
- Improper storage, use, or handling
Excluded are: Normal wear and tear, accessories, batteries, and accumulators.
In case of guarantee claim, there is a right to:
- Rectification,
- Replacement delivery or
- Conversion (credit at current price, max. original selling price) – the choice lies with Cre-A-Solve AG.
The guarantee period is not extended by a guarantee claim. An exchange does not lead to new periods. Guarantee claims are not transferable. The statutory warranty is fully excluded.
9. Returns
Products can be returned within 14 days of delivery, provided they are unopened and unused. The return must be registered via the customer account or by email to [email protected].
After receipt of the return, a credit of the purchase price (minus any payment fees) will be made to the customer account.
Deductions on return:
- damaged packaging
- signs of use
- missing accessories
- agreed shipping costs
Refund rules:
- Full refund for unopened, undamaged original packaging
- Deduction of at least 10% or CHF 10.– for opened or used items
Return costs: The customer generally bears the shipping costs. Exceptions:
- wrong item delivered
- incorrect information in the shop
- incomplete delivery
The goods must be securely packaged – damage due to inadequate packaging will be charged. Risk during return shipping lies with the customer and only transfers upon arrival at Cre-A-Solve AG.
No return right for:
- damaged items
- missing original packaging
- missing accessories

10. Payment
The available payment methods are visible in the online shop. Cre-A-Solve AG reserves the right to conduct a credit check if necessary according to the privacy policy. A payment is only considered made when Cre-A-Solve AG has access to the amount.
In case of payment default (payment not within the deadline), Cre-A-Solve AG is entitled to charge default interest of 5% p.a. In addition, it may withdraw from the contract, demand return of delivered goods, and claim damages. All outstanding claims become immediately due when:
- the customer defaults on payment
- essential contractual obligations are violated
- circumstances become known that reduce creditworthiness (e.g., bankruptcy proceedings)
In such cases, Cre-A-Solve AG may withhold deliveries or only execute them against advance payment or security.
10.1 Purchase on Invoice
With the payment method "Purchase on Invoice", the order can be conveniently paid after receipt of the goods. Payment processing is done directly and securely via Payrexx.
- Payment period: 20 days from invoice date
- Invoice: Sent by email after purchase
- Credit check: Payrexx may conduct a check as part of payment processing. In case of negative check, advance payment may be required.
10.2 Payment Reminder and Collection Process
- 5 days after due date: Friendly payment reminder by email
- 10 days after due date: First reminder with reminder fee of CHF 10.–
- Further reminder stages: Additional fees possible
- In case of continued non-payment: Handover to a collection agency with additional processing fees and default interest of 5% p.a.
11. Reminder and Collection Fees
In case of payment default, the customer is reminded by email, in writing, or by phone. Reminder fees according to section 10.2 may be charged. In case of unsuccessful reminders, the claim may be assigned to a collection agency that may charge additional processing fees.
12. Liability Limitation
Claims for damages against Cre-A-Solve AG, its auxiliary persons, or substitutes are excluded unless intentional or grossly negligent behavior is present. No liability is assumed for consequential damage through product use.
13. Data Protection
Cre-A-Solve AG commits to compliance with data protection requirements. Details can be found in the privacy policy, which is an integral part of these terms and conditions. By agreeing to the terms and conditions, you also accept the privacy policy.
14. Jurisdiction
CH-8360 Eschlikon is exclusively the place of jurisdiction for all disputes arising from the contractual relationship. Swiss law applies exclusively.
15. Final Provisions
Cre-A-Solve AG reserves the right to change the terms and conditions at any time. If a provision of these terms and conditions is invalid, the validity of the remaining provisions remains unaffected. The corresponding legal regulations apply.
